La France n'est pas une République bananière : La Cour de cassation a annulé l'extradition d'Innocent Musabyimana

"La Cour de cassation a cassé et annulé aujourd'hui l'avis favorable donné en janvier par la cour d'appel de Dijon (centre) à l'extradition d'Innocent Musabyimana, un Rwandais recherché par son pays pour génocide et crimes contre l'humanité.
La cour d'appel de Dijon n'a pas recherché "si les faits justifiant l'extradition étaient punis par une loi rwandaise antérieure à la date à laquelle ils auraient été commis" et par conséquent "n'a pas donné de base légale à sa décision", selon la Cour de cassation.
Pour l'avocat de M. Musabyimana, Me Philippe Meilhac, "cette décision réaffirme les principes de l'égalité des délits et des peines et de non-rétroactivité".
"Nous espérons que cette décision va dissuader le Rwanda de conduire ce type de démarche voué à l'échec", a-t-il ajouté..."
