La Cour de cassation a rejeté mercredi les demandes d'extradition de trois Rwandais réclamés par Kigali pour leur implication présumée dans le génocide de 1994.
La haute juridiction a confirmé sa jurisprudence en la matière dans trois arrêts consultés par l'AFP. La justice française s'est au final toujours opposée à la remise aux autorités rwandaises de complices présumés des tueries qui ont fait 800.000 morts selon l'ONU, essentiellement au sein de la minorité tutsi.
Mercredi, la Cour a cassé les avis favorables à l'extradition qui avaient été rendus en novembre par la cour d'appel de Paris contre Claude Muhayimana et Innocent Musabyimana. Elle a, dans un troisième arrêt, confirmé l'avis défavorable à l'extradition de Laurent Serubuga, pris en septembre par la cour d'appel de Douai.
Dans ses décisions, elle justifie avec force sa position en invoquant notamment le principe de «non-rétroactivité de la loi pénale», selon lequel on ne peut être jugé pour une infraction qui n'était pas définie par la loi à l'époque où les faits ont été commis.
Les demandes rwandaises d'extradition concernent «des faits qualifiés de génocide et de crimes contre l'humanité qui n'étaient pas incriminés par l'Etat requérant à l'époque où ils ont été commis», souligne la Cour.
Le génocide est poursuivi au Rwanda en vertu de lois datant de 1996 et 2004, donc postérieures aux tueries.
En France, les crimes contre l'humanité sont définis dans le code pénal depuis 1994. C'est en vertu de cette loi que Pascal Simbikangwa, un ancien capitaine de la garde présidentielle rwandaise, est actuellement jugé à Paris dans le premier procès en France d'un complice présumé du génocide.
M. Muhayimana, un des trois hommes dont Kigali réclamait l'extradition, pourrait également être jugé un jour par la justice française puisqu'une information judiciaire a été ouverte en juin 2013 à son encontre au pôle «crimes contre l'humanité» du tribunal de grande instance (TGI) de Paris.
